While fans there declared themselves on either "Team Amber" or "Team Johnny", in the shots, the placards read "Team Kelsey" and "I stand with Austin" - supposedly the name of Kelsey's famous ex, who she is now either suing or being sued by. Elsewhere, ADA Dominick "Sonny" Carisi, Jr. played by Peter Scanavino, can also be seen, suggesting he will be defending Kelsey during the trial.

The episode, if it does feature as the premiere episode for the upcoming season, will air on Thursday 22 September 2022 in between new episodes of the recently rebooted main series Law & Order and Christopher Meloni-led sister show Law & Order: Organized Crime.

The NBC drama is notorious for its "ripped from the headlines" storylines which take inspiration from real-life criminal cases and incidents, with recent episodes exploring Britney Spears' conservatorship and the crimes of fake heiress Anna Delvey.

Well, you knew this was coming. For nearly a quarter of a century (!) now, we’ve relied on Law & Order: SVU to fulfill a number of often contradictory functions in society: There’s the obvious, ripped-from-the-headlines entertainment value that’s arguably gone on to spawn our current era of true-crime obsession, but by proffering alternative narratives where justice is reliably served, there’s also a healing function to it, especially for survivors of sexual assault. On one hand, the NBC stalwart is unambiguously pro-police (at the end of the day, Olivia Benson is basically a magical cop), yet the show also serves as a useful mirror to our own changing understandings about say, misogyny, technology, or the criminal justice system. After all, SVU is nothing if not self-conscious about its cultural relevance, as we saw when season 24 opened in September with a Ukraine war story line. Of course they were going to put a classic Dick Wolf spin on this past spring’s Johnny Depp and Amber Heard trial. Let’s see what changed when the former celeb couple’s Wolf-ian proxies took the stand.

In this episode, titled “Mirror Effect” and originally aired October 6, the SVU fun house mirror shrinks Depp and Heard down into a 20-something influencer-y couple. At a red-carpet event, we’re introduced to Kelsey Jones, a budding “Nashville songbird,” and Austin Boyer, whose professional title seems to be “bad boy.” (Hilariously, Austin also appears to be a simulacrum of Machine Gun Kelly, thanks to the pink suit, bare chest, and piles of jewelry that’s not not reminiscent of the way Kelly and Megan Fox chained themselves together last winter). Together, Kelsey and Austin apparently have 30 million followers on their joint social media account, which I found a little unrealistic (the Extremely Online Olivia Rodrigo, for comparison’s sake, has fewer than 28 million Instagram followers; later in the episode, Carisi says Austin has 40 million followers on his own), but such is the uncanny valley of SVU Land.

In the episode’s B-plot, Detective Rollins is still recovering from the trauma of getting shot in the season premiere; after a terse reminder from her therapist that she needs to take her recovery seriously, she’s on a much-needed date night with ADA Carisi when the two bump into Kelsey and Austin in the middle of an ugly fight. Kelsey is standing outside the stretch limo and throws a Champagne bottle at Austin, which shatters; Austin and the limo leave her stranded on a corner. Rollins and Carisi give Kelsey a ride home while the shaken celeb sadly explains, “This is what we do. We fight, make up, it’s our foreplay. Austin calls it five-play.” Her dress is missing a strap, but Austin is waiting forlornly outside by the time Kelsey’s dropped off, and the couple embrace in apparent reconciliation. Rollins immediately gets bad vibes about the entire thing.

The next day, Kelsey comes into the station with a black eye. She relays the fight in the limo to Captain Benson, but with the caveat that he “didn’t really do anything” since Austin passed out at home before things got worse. When Benson questions Austin at his rooftop pad, he angrily lawyers up. Carisi worries over how to prosecute a celebrity he-said, she-said and narrates the crux of the episode, which again reflects a sentiment many had about the real-life Depp-Heard defamation trial: “This is going to come down to a popularity contest.” Later, the SVU team investigates a call that Kelsey’s mom makes in the aftermath of another fight. This time, Kelsey tells the cops, “He got what he wanted.” (It’s worth noting, Depp v Heard was not a criminal trial, but a civil defamation case that Depp initially commenced against Heard over statements she’d made in a Washington Post op-ed.)

Interestingly, SVU doesn’t actually lean into the viral factor of the Heard-Depp trial. Unlike the inescapable social media armchair lawyering that took place in the realm of the living: We see Kelsey scrolling through some memes accusing her of being a liar and complaining about TikTok trolls raking in the likes at her expense, and we also observe the modest crowd waiting outside the courthouse throughout proceedings holding up “I Stand with Austin!” posters done in curlicue handwriting. At one point, an Austin fan interrupts Kelsey’s testimony by jumping up and screaming, “What is wrong with you? Why are you trying to hurt him?” and then siccing the crowds on Rollins too, for her role in Austin’s arrest. “Austin would never hurt anybody!” the fan insists, reminding us all too well of the widely documented, fully parasocial loyalty of Depp’s female supporters during the real-life trial in Virginia. In a gesture suggestive of the intensity of Austin’s Depp-style fandom, the judge agrees to keep fans out of the courtroom.

SVU devotes the rest of the episode to coloring in Austin’s and Kelsey’s backstories. We learn that Kelsey grew up in a Kentucky trailer park and has an overbearing, manipulative mother who tells the court about reading the “lies” Kelsey used to write in her journal; Austin’s dad, who shows up glumly to the trial, is an alcoholic and domestic abuser himself. Toxic relationships that lead to abuse, SVU posits here, are a generational matter. It’s never one person’s fault, and we, the audience, are largely absolved in this matter.

The other theme that SVU pursues is Kelsey’s credibility—and culpability: She waffles between wanting justice and repairing her relationship with Austin, and says on the stand that while Austin was physically and verbally abusive, “I admit, I was too.” This, too, is a callback to the way Depp and Heard’s former marriage counselor typified the pair’s relationship as one of “mutual abuse” on the stand during the seven-week trial. It’s not the first time that SVU has defended the archetypal imperfect witness, so I wish the show sunk its teeth a little further into the way, for Heard at least, this dissonance spiraled into full-out conspiracy theories about the real-life actor sniffing cocaine on the stand or pretending to cry. What the Depp-Heard trial made clear was not merely the fact that a high-profile trial involving domestic abuse can denature into a matter of public opinion; it showed just how enormously the digital age has enlarged the scale of that public opinion—into a deluge of TikToks, online harassment, and meme pile-ons.
