My husband (a PR) filed an I-130 online for me on July 2020. We received NOA a week after.

Nov. 30, our case status was updated to "My Case Is Being Actively Reviewed By USCIS". It's also stated inside that "Our records show nothing is outstanding at this time. We will let you know if we need anything from you. "

How long might that review take? I don't want to be checking obsessively throughout the Christmas season.

Hey there, my husband (USC) and I (beneficiary) filed our I-130 online at the beginning of May. As of today, we got a notification stating "As of September 15, 2021, we are actively reviewing your Form I-130, Petition for Alien Relative, Receipt Number IOEXXXXXXXXXX. Our records show nothing is outstanding at this time. We will let you know if we need anything from you."

We are doing consular processing and according to the NOA1 (receipt we got the day after we filed), our case is being processed at the Nebraska Service Center. Does anyone know how long on average it takes to get a decision after the case is in this status? Perhaps some of you have gone through the same or similar process?

Also, does anyone know, on average, how much longer it takes if we're approved? I read you have to go through the NVC process before scheduling an interview at the Embassy.

*UPDATE*

Just got the approval notice on Dec 6th. That being said, it was kind of a weird process. So my husband called USCIS multiple times on Nov 30th because the priority date for Nebraska was up. USCIS tier 1 officer kept saying that our case was within processing times since according to them it was being processed in Potomac and not Nebraska, although we never received notice of this and our receipt notice was from Nebraska. Husband called again and on that same day another agent said nope, it was being processed at the Texas Service Center. At this point we requested to be put on the waitlist to speak to a Tier 2 officer since USCIS could not decide where the heck our case was, and since we were put on "Actively Being Reviewed" status since Sept 15th, it seemed weird. We also contacted our local congressman to put pressure on this (although we never found out if he got around inquiring on the case or not).

The following Monday we received an approval notice (Lawfully app notified us of an update on our case). Oh and guess what? Approval letter came from the National Benefits Center. So turns out our case had been processing there the whole time? Who knows. And USCIS somehow could not tell us that lol. If you have any issues I highly recommend speaking to your local congressman/woman, and definitely persist on USCIS customer service to get answers if your case is past the priority date, or at least get on the Tier 2 officer callback to get answers. T

I'd love to say I have a magical formula as to why our case got approved just now, but truly idk if it had something to do with my husband calling like six times to the USCIS, or the congressman inquiring on the case, or our attempt to contact the Ombudsman office on our case, or it just happened to be the time they finished processing. At this point, we're just glad USCIS stage is over and now on to NVC stage. We're definitely relieved although still frustrated as this took a lot of patience and it was emotionally draining, especially when they would not tell us with certainty where the heck our case was.

Also, in case your case has been "transferred" with or without notice: Technically, on their website USCIS states that transfers do not affect processing, hence, I never understood how they tried to convince my husband that because our case was at a different service center than the one that they sent us the receipt notice from, that it was justified to not have a response yet (Although our priority date for the receipt notice was up). We used this and the fact different officers told us our case was being processed at different service centers, to keep trying to get answers and eventually get on the list for a Tier 2 officer, although we never actually got their phone call since our case was approved before they called. However, had it not, I feel like this would have been a good opportunity to get some answers and possibly request expedite because of USCIS error.

Most Form I-130 petitions for immediate relatives are approved within a 5 to 9 month time frame, but they can take longer in some cases. If you are in the United States and also filed an application to adjust status, USCIS will begin reviewing Form I-485 at this point.
